           There is abundant evidence of the use of abusive, deceptive, and unfair debt collection practices by many debt collectors. Abusive debt collection practices contribute to the number of personal bankruptcies, to marital instability, to the loss of jobs, and to invasions of individual privacy.

           It is the purpose of this site to assist victims of abusive debt collection practices by debt collectors, to insure that those debt collectors who refrain from using abusive debt collection practices are not competitively disadvantaged, and to promote action to protect consumers against debt collection abuses.

           The Fair Debt Collection Practices Act creates an enforcement mechanism by private FDCPA attorneys though what is known as a "fee-shifting" provision. This means that a debtor or otherwise individual whose rights have been violated may recover their attorney’s fees in a prevailing action. This creates a level playing field where victim may obtain an attorney where they would have otherwise never been able to afford one.

Most debt collection companies are aware that they are liable for paying for a victim’s attorney’s fees if they take a case to court and lose. This could amount to $10,000, $15,000 or more PLUS their own attorney’s fees! As a result, when you obtain an attorney it is far more likely that the debt collection company will immediately cease any prohibited actions and offer to settle FDCPA violations by paying you (up to $1,000 plus actual damages/attorney’s fees) without going to court.
