I am on the Do Not Call List, why am I still getting these debt collection calls?
The “Do Not Call” registry has absolutely nothing to do with collection calls. The registry prohibits telemarketers from calling you. Anyone else may call your number.

I’ve already complained to the attorney general’s office, the FTC and the BBB, why am I still getting called?
The state attorney general's office or FTC will not handle your individual case. The BBB and National "Do Not Call List" are irrelevant to exerting your rights against debt collection violations/calls. The federal Fair Debt Collection Practices Act (FDCPA) specifically addresses all debt collection issues. File a Debt Collection Violation Report to stop the calls.

How is it that the FDCPA attorneys listed on this site don’t charge me for representation?
Here is a summary of the relevant law 15 U.S.C. section 1692(k):
Except as otherwise provided by this section, any debt collector who fails to comply with any provision of this subchapter with respect to any person is liable to such person in an amount equal to the sum of--
(1) any actual damage sustained by such person as a result of such failure;
(2)(A) in the case of any action by an individual, such additional damages as the court may allow, but not exceeding $1,000; or
(3) in the case of any successful action to enforce the foregoing liability, the costs of the action, together with a reasonable attorney's fee as determined by the court.

The attorneys listed on this site will represent you on a “contingency-fee” basis and only recover their fees from the debt collection company anyway. So you stand to get up to $1,000. They attorney will receive his/her fees from the debt collection company (or from judgment) because the law (as listed above) allows Plaintiff to recover attorney’s fees. This is why most all of these FDCPA violation cases settle without going to court. The collection companies that have violated the FDCPA know that if they fight it and lose, they will pay for their attorney’s fees AND YOURS. If you lose, you pay nothing.

How long does it usually take for the calls to stop after I submit a Debt Collection Violation Report?
That depends on your case, but the calls should usually stop within a few days, sometimes sooner.

What law is it that says I get $1,000.00?
